Terms of Service

By using https://optiveex.store, purchasing an Optivex digital product, or engaging Optivex for Shopify services, you agree to these Terms of Service.

If a signed proposal, statement of work, invoice, checkout page, or separate agreement applies to your purchase or project, that document may include additional terms that also apply.

Optivex sells digital Shopify themes, design resources, and related products. Optivex also provides custom Shopify design, Shopify development, theme customization, performance optimization, migration, and support services.

Digital product features, deliverables, compatibility notes, and support terms are described on the relevant product, checkout, proposal, or service page.

Prices may be listed in the checkout, proposal, invoice, or written agreement. Unless stated otherwise, prices do not include taxes, third-party app fees, Shopify subscription fees, payment processor fees, domain costs, or other external costs.

Payments for digital products may be processed through Lemon Squeezy. Custom development projects may require deposits, milestone payments, or full payment before final delivery.

Optivex owns its brand, website, original theme files, design systems, documentation, copy, code, creative assets, workflows, and other intellectual property unless otherwise agreed in writing.

When you purchase a Shopify theme, you receive a limited license to use that theme under the applicable License Agreement. Purchasing a digital product does not transfer ownership of Optivex intellectual property.

You are responsible for providing accurate information, reviewing deliverables, securing your Shopify account, maintaining necessary subscriptions, and ensuring that your store content, products, claims, policies, and legal compliance are appropriate for your business.

For custom development projects, delays in feedback, assets, approvals, or access may affect timelines and delivery dates.

Optivex provides digital products and services with professional care, but we do not guarantee specific sales, revenue, conversion rates, rankings, traffic, or platform outcomes.

Themes and services are provided on an as-available basis, subject to Shopify platform changes, third-party app behavior, browser updates, and other factors outside our control.

To the fullest extent permitted by law, Optivex is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the website, digital products, themes, or services.

Optivex's total liability for a claim is limited to the amount paid to Optivex for the specific product or service giving rise to that claim.

These terms are governed by the law specified in the applicable proposal, invoice, checkout terms, or written agreement. If no governing law is specified, the terms are governed by the laws applicable to Optivex's place of business, without regard to conflict-of-law rules.
